General Terms and Conditions of Sale

2. Products

PicoKeebs offers handcrafted USB MIDI controllers, including the PicoDeon, as well as any other products listed in the site catalogue. The essential characteristics of each product are described on the corresponding product pages (dimensions, materials, features, compatibility).

Images and illustrations on the site are provided for informational purposes and are not contractually binding. Products are offered subject to available stock.

3. Prices

Prices are listed in euros (€) and are final (no VAT applied — "VAT not applicable, art. 293 B of the French Tax Code").

Shipping costs are shown separately and stated before order confirmation. PicoKeebs reserves the right to change prices at any time, but products will be invoiced at the rate in effect at the time the order is confirmed.

4. Ordering

Order process:

5. Order confirmation by email

The customer must verify the accuracy of their order before confirming it. Any errors may be corrected before final validation. The order becomes final upon receipt of payment. A confirmation email summarising the order details, total amount paid, and shipping information is sent to the customer.

Any contract worth €120 or more is retained by PicoKeebs for 10 years in accordance with article L. 213-1 of the French Consumer Code. The customer may access it on request at: contact@picokeebs.fr.

5. Payment

Accepted payment methods: credit card (Visa, Mastercard, American Express) via the secure Stripe platform.

Payment is collected in full at the time of order confirmation. No additional fees are applied based on the payment method used. Transactions are secured by the SSL protocol (Stripe). PicoKeebs does not store any banking data.

6. Delivery

Delivery zones: worldwide.

Carrier: Delivengo (subsidiary of La Poste, specialised in international delivery).

Timeframes: Orders are processed and shipped as soon as possible after payment validation. Delivery times vary by destination and are indicated for information purposes at the time of ordering.

Tracking: A tracking number is sent by email upon dispatch.

Non-receipt: If delivery is not received within an abnormally long period, the customer should contact PicoKeebs at contact@picokeebs.fr.

In the event of a delay attributable to the carrier, PicoKeebs cannot be held liable, but will make every effort to resolve the issue.

7. Right of Withdrawal

In accordance with articles L. 221-18 et seq. of the French Consumer Code, the consumer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to provide a reason.

Exercising the right of withdrawal:

The customer notifies their decision to withdraw before the expiry of the 14-day period, either:

• Using the standard withdrawal form below (appendix)

The product must be returned to the following address within 14 days of sending the notification:

Return costs: The return shipping costs are the responsibility of the customer.

Refund: PicoKeebs will refund the full amount paid (product price + standard initial shipping costs) within 14 days of receiving the withdrawal notification or the returned product, whichever comes first. The refund is made via the same payment method used for the order (Stripe).

Important: If the customer is not informed of their right of withdrawal before the contract is concluded, the withdrawal period is extended to 12 months.

Exceptions to the right of withdrawal: In accordance with article L. 221-28 of the French Consumer Code, the right of withdrawal does not apply to:

• Goods made to the consumer's specifications or clearly personalised
• Sealed goods that have been opened after delivery and cannot be returned for health or hygiene reasons (where applicable)

8. Legal Warranties

8.1 Legal warranty of conformity (articles L. 217-4 to L. 217-14 of the French Consumer Code)

In the event of a lack of conformity, the customer may obtain the repair or replacement of the goods within 2 years from delivery. During the first 24 months, the defect is presumed to have existed at the time of delivery. The customer does not have to advance the costs of implementing this warranty.

8.2 Legal warranty against hidden defects (articles 1641 to 1649 of the French Civil Code)

In the event of a hidden defect rendering the product unfit for its intended use, or diminishing its use to such an extent that the buyer would not have purchased it or would have paid a lower price, the customer may obtain a full refund (rescission of the sale) or a partial refund (price reduction). The action must be brought within 2 years of discovery of the defect.

9. Liability

PicoKeebs undertakes to do everything possible to ensure the availability and quality of its site and products. However, PicoKeebs cannot be held liable for damages resulting from use of the product contrary to the instructions provided, modification of the product by the customer, or any force majeure event.

10. Intellectual Property

The brands, logos, designs and other distinctive elements associated with PicoKeebs products are the exclusive property of Antonin Chabaud-Pech. Any reproduction without authorisation is prohibited.

11. Personal Data

The processing of personal data is described in the Privacy Policy accessible from the site footer.

12. Mediation and Dispute Resolution

In the event of a dispute not resolved amicably with PicoKeebs (after a prior written complaint sent to contact@picokeebs.fr), the consumer may have recourse, free of charge, to the consumer mediation service:

13. Applicable Law

These GTCS are governed by French law. In the event of a dispute between a professional and PicoKeebs, the competent court shall be that of Sète. In the event of a dispute with a consumer, the statutory rules of jurisdiction shall apply.
